Abstract
ENGLISH:
The presence of Syari ah Pawnshop as a rapid development from bank, BMT, and insurance which based on syariah principles and also formal finances institution in Indonesia needs to be greeted positively. Because this presence is hoped to help the society could be released from any practices which contain elements prohibited by Islamic law such as riba, which could harm the people. Those prohibited elements in pawning agreement activities will bring lot of disadvantages instead of advantages. That s why the presence of Syari ah Pawnshop, which has been conducting among the society so far, is hoped to be able to work adjusted with its main purpose. Also, it could really function as an institution which could give lots of advantages to the society.
The purpose of this research is to acknowledge the operational mechanism of pawning in Syari ah Pawnshop and Islamic law observation upon it.
The method which is used in this research is descriptive method by selecting the research subject in branch office oh Syari ah Pawnshop Landungsari. The primer data resource is gained from the result of interview and the secondary data resource is gained from several literature related with pawning.
The result of this research shows that the operational mechanism of pawning in Syari ah Pawnshop covers akad consisting two transactions; akad rahn and akad ijarah, the type of allowed things as a guarantee in Syari ah Pawnshop Landangsari are only gold and diamond, pawning issue loan procedure, pawning payment loan procedure, and pawning commodity auction. It adjusts with the Islamic law because in conducting its business, Syari ah Pawnshop hold on to instructions of Dewan Syari ah Nasional (DSN) which is DSN instruction NO. 25/DSN-MUI/III/2002, 28 march 2002 about rahn and DSN instruction NO. 26/DSN-MUI/III/2002, 26 June 2002 about gold rahn.
